US Court Mandates Release of Abrego Garcia from ICE Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in immigration custody.
In her order, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Context of the Case
The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.
Conditions of Freedom
The court, who was overseeing his challenge to removal in a Maryland district court, determined that he must now adhere to the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
